Section 504

In compliance with its obligations under both Section 504 of the Rehabilitation Act of 1973 and Title II of the Americans with Disabilities Act, Independent School District 709 does not discriminate against otherwise qualified students with disabilities in the provision of educational programs and activities.

Ban Ka Santu 2019It is the intent of Independent School District 709 to provide a free and appropriate public education to each Section 504 qualified and eligible student with a disability within its jurisdiction.  Students, who because of a disability, need or are believed to need reasonable accommodations, services, and/or programs are addressed under this policy. A qualified student has (1) a physical or mental impairment (2) that substantially limits (3) a major life activity.

Ban Ka Santu 2019Students who are identified as individuals requiring special education under the Individuals with Disabilities Education Improvement Act (IDEIA) criteria are not addressed under this policy, as the needs of such students are provided for under state and federal law, and ISD 709 special education procedures.

Purpose

The purpose of this policy is to protect students with disabilities from discrimination on the basis of disability and to identify and evaluate learners who, within the intent of Section 504 of the Rehabilitation Act of 1973, need special services, accommodations, or programs in order that such learners may receive a free appropriate public education.

General Statement of Policy

Ban Ka Santu 2019A. Students with disabilities who meet the criteria of Paragraph C below are protected from discrimination on the basis of a disability.

B. It is the responsibility of the school district to identify and evaluate learners who, within the intent of Section 504, need special services, accommodations, or programs in order that such learners may receive a free appropriate public education.

Ban Ka Santu 2019C. For this policy, a learner who is protected under Section 504 is one who:

1.  has a physical or mental impairment that substantially limits one or more major life activities, including learning; or

2.  has a record of such impairment; or

3.  is regarded as having such impairment.

D. Learners may be protected from disability discrimination and be eligible for services, accommodations, or programs under the provisions of Section 504 even though they are not eligible for special education pursuant to the Individuals with Disabilities Education Act.

The Assistant Superintendent is the school district’s Americans with Disabilities Act/Section 504 coordinator. Persons who wish to make a complaint regarding a disability discrimination matter may use the accompanying Student Disability Discrimination Grievance Report Form. The form should be given to the ADA/Section 504 coordinator.
